MONITORING OF POLITICAL PERSECUTION IN THE REPUBLIC OF KAZAKHSTAN from 1 to December 31, 2024

December 2, Karaganda, Zhezkazgan, Shymkent, Taraz, Almaty, Taldykorgan, Semey, Ust-Kamenogorsk, Pavlodar, Petropavlovsk, and Astana, local authorities rejected applications to hold peaceful rallies to return to the old time and time zones. The reasons for the refusals vary: other events were planned in some places; a wrong regulation was given in others[1].

December 2, the Foundation for Support of Victims of Domestic and Sexual Violence #NeMolchyKZ declared that it is on the verge of closure due to pressure from the Ministry of Interior of Kazakhstan. December 2, Almaty, Ukrainian and Russian citizen Yevgeny Nakaznenko refused to grant asylum in Kazakhstan,”After a thorough examination of the case materials and after hearing the arguments of the applicant, the Department of Employment and Social Programs of Almaty, taking into account the recommendation of the Commission No. 12 of 28.11.2024, decided to refuse to grant refugee status in the Republic of Kazakhstan”, — said in a copy of the decision[3].

December 3, Astana, “The state has to see NGOs as partners, not as a threat”, — this statement was made by Diana Okremova, Director of the Legal Media Center PF[4].

December 4, Taldykorgan, D. Muhammetkarim, Articles 258, 405 of the Criminal Code of the Republic of Kazakhstan, 7 years of imprisonment. The prisoner was held for 2 days in the pre-trial detention center in a cold punishment cell on the concrete floor without warm clothes. In protest, he wrote on the walls with his blood. They are trying to “break” him again. In protest, Duman “made deep cuts in his arm, stomach and throat and wrote ‘Oyan Kazakh’ on the walls of the punishment cell with his blood”[5].

December 4, Almaty, supporters of the abolition of the single time zone spoke at a press conference. Their arguments that the single time zone negatively affects Kazakhstanis are based on the results of sociology and statistics. They believe that the transition to a single time zone will not only negatively affect the health of Kazakhstanis, but also reduce consumption and increase the level of crime[6].

December 5, Aktau, a man set himself on fire in front of the Akimat of Mangistau region after he was denied a meeting with the head of the region. Aktau police opened a criminal case on the fact of incitement to suicide[7].

December 5, Zhanaozen, the workers of the “Drilling Works Department” of the “Ozenmunaigas” contracting organization stopped their strike. It was agreed that the workers would not be prosecuted and would be paid 100% of their salaries[8].

December 5, in Astana, a parent of girls who wear headscarves won a court case against a school where girls were not allowed to attend classes because their heads were covered with headscarves. The Supreme Court agreed with the conclusions of the appellate court (the decision of the Specialized Interdistrict Administrative Court was revoked and a new decision was made to satisfy the claim), as the right to education is one of the basic constitutional rights of citizens of the Republic of Kazakhstan[9].

December 5, the Committee of Criminal Executive System (KUIS) denied the lawyer’s statement that the convicted journalist D. Muhammedkarim had made cuts on himself in order to be transferred from the Taldykorgan pre-trial detention center to a colony in the Almaty region. Following the statement of the CUIS, the lawyer Nurpeisov G. told the correspondent of “Vlasti” that he himself saw the cut marks on his client’s body[10].

December 5, Ust-Kamenogorsk, Leonid Kartashyov — one of the organizers of the unauthorized rally against the time change today had an unpleasant conversation with employees of the Akimat. At least seven employees of the Akimat spoke out against the military on retirement[11].

December 5, Astana, the presentation and discussion of alternative reports prepared for Kazakhstan’s report to the UN Human Rights Council under the Universal Periodic Review (UPR) concluded. December 6, East Kazakhstan region, residents of the village of Maraldy protested against the construction of a gold mining company, saying that the technology used would damage wildlife. The area is home to Red Book animals, birds, fish and plants[17].

December 6, Astana, the court informed about the reason for rejecting the claims of a group of citizens of Kazakhstan who filed a complaint to the Supreme Court complaining about the “inaction” of court officials[18].

December 6, Ust-Kamenogorsk, activists were repeatedly denied permission to hold a peaceful rally dedicated to moving the country to a single time zone. On December 13, activists were banned from holding a rally. The reason given was that there would be another event there[19].

December 9, Almaty, Hieromonk Iakov Vorontsov, deprived of his dignity, who criticized the Kremlin’s policies, the war in Ukraine and the leadership of the Russian Orthodox Church and called for Kazakhstan’s withdrawal from the EAEU and CSTO, reported that he was prosecuted under Article 174 of the Criminal Code of the Republic of Kazakhstan — inciting social, national and religious discord[20].

December 9, at the session of the administrative court the suit of activist E. Dosanov on the recognition of illegal forced collection of a fine was satisfied. The court decided to issue private rulings on the illegal actions of bailiffs and police officers of Zatonskiy police department [21][22].

December 9, the Legal Media Center Foundation announced the completion of the Human Rights Measurement Initiative (HRMI) project. In 2024, the results are as follows: the observance of the right to an adequate standard of living — 82.7%, which is lower than the average indicator in CA countries. The right to protection from arbitrary arrest, torture and other violations is rated 6.4 out of 10. The level of civil and political freedoms — 3.5 points out of 10, which indicates their poor realization[23].

December 9, Astana, Administrative Court rejected 9 citizens in the suit against the Prosecutor General of Kazakhstan B. Asylov on the recognition of improper consideration of citizens’ appeals illegal, on the recognition of his actions to refuse personal reception of citizens illegal[24].

December 10, Astana, activist E. Bekzadina was arrested during a peaceful picket in support of political prisoners, charged under Article 669 of the Code of Administrative Violations of the Republic of Kazakhstan, and fined 5 MCI, equivalent to 18460 tenge (USD 35)[25].

December 10, Talgar city, Aitbek Amangeldy, a human rights activist who helps the family of the deceased Sherzat Bolat, revealed the details of the death of Nurganat Gaipbaev, the uncle of the murdered teenager. According to Amangeldy A., the defenders and family members received a medical report, which concluded that the death of Gaipbaev N. occurred as a result of asphyxia due to hanging or strangulation[26].

December 10, Almaty region, Kaskelen city, a trial is underway, as a result of which two suicide attempts have already taken place. A case of torture has also been opened. On December 10, the International Human Rights Day, the defendant Elizaveta Terentyeva, accused of organizing cross-border drug trafficking, slit her wrists during the trial. In doing so, she was protesting both against the charges and against the trial, which was presided over by Judge M. Tokhtakhunov[27].

December 11, Stepnogorsk, Institution No. 4, M. Zhylanbaev, Articles 258, 405 of the Criminal Code of the RK, 7 years’ imprisonment. The health of M. Zhylanbaev, who continues his hunger strike, has deteriorated. His daughter Asia Zhylanbaeva said that her father has symptoms of bradycardia, i.e. slowing of the heart rhythm[28].

December 11, Almaty, A. Mubarakov, Article 272 of the Criminal Code of the RK, went on hunger strike in protest against his political persecution. A.Mubarakov was arrested before the referendum on the construction of nuclear power plants in Kazakhstan in the framework of a fabricated and secret criminal case on alleged preparation of “mass riots” and preparation of a coup d’état[29].

December 11, Almaty region, the Enbekshikazakh district court sentenced K. Nurymov, the father of the murdered teenager, to 15 days’ imprisonment and found him guilty of violating public order. His sister S. Nurumova was also fined 20 MRP (about USD150) for disorderly conduct. His cousin B. Reimova was detained by the court for 15 days with further deportation, as she has no citizenship (she is from Karakalpakstan). Her actions were found to be calling for rallies (she was live streaming during her brother’s funeral)[30].

December 11, Talgar city, lawyers of the family of the deceased Sherzat Bolat informed about the condition of his father, Karzhaubai Nurymov, who was arrested for 15 days for disorderly conduct. The defense lawyers said that K.Nurymov did not attack the police officers, but was in an emotional distress, he did not eat and did not sleep for several days after the death of his brother[31].

December 11, Ulytau region, Satpayev city, activist Nurbolat Bazarbekuly must pay 100 thousand tenge and make a public apology to the general director of «Kaz Green Energy» LLP V.Sibagatulin. The reason for the trial was a photo of the plaintiff from his Facebook page, which Nurbolat posted on his social networking site[32].

December 11, Mangistau region, Munaylinsky district, U. Turdiyeva. A court hearing was held on the application of the activist to cancel the protocol under Article 434, Part 1 of the Code of Administrative Offences of the RK, allegedly for disorderly conduct. The court decided to leave the complaint to cancel the protocol without satisfaction [33].

December 11, Kyzylorda, Kanysh Beskulakov: On December 5, police officers in a white car “Niva” without introducing themselves forcibly put him in the car and took him to the city department of internal affairs. He was falsely accused under Article 380, Part 2 of the Criminal Code of the RK [34].

December 11, Almaty, before the announced rallies, police officers came to N. Dzhumaniyazova’s house with the demand to report to the probation department of the Alatau district the next day at 9 a.m.[35].

December 11, Almaty, “The latest news from Syria has caused panic and fear among the authorities in Kazakhstan. We started receiving information about detaining activists for preventive conversation, in order to remove «unreliable» posts. December 12, Astana, appeal of activist Amangeldy Dzhakhin to Ombudsman A. Lastaev regarding the life, health and legal rights of M. Zhylanbaev, who is currently imprisoned[38].

December 12, Almaty region, Talgar, “In connection with Karzhaubai Nurymov police launched a pre-trial investigation under Article 202 of the Criminal Code of RK (“Deliberate destruction or damage to other people’s property”)”, — wrote lawyer Kaymakov[39].

The murder of journalist Aidos Sadykov in Kiev is considered to have been “ordered by Kazakhstan”[42].

December 13, Konayev, Almaty Regional Court appeal left unchanged the ruling on the arrest for 15 days of Karzhaubai Nurumov, father of the murdered Sherzat Polat[43].

December 13, Astana, the Ministry of Justice of Kazakhstan will interact with the Ministry of Justice of the Russian Federation in the field of legal regulation of non-profit organizations. Internet resource “Vlast” informs that the matter is about exchange of experience and texts of regulatory legal acts on law enforcement practice, as well as on the legislative process in this sphere[44].

December 15, according to the Center for Analysis and Investigation of Cyberattacks “TSARKA” an abnormal increase of fakes about rallies was recorded in Kazakhstan, in Almaty and other cities. «Since the beginning of this week, the Center has registered abnormal activity in social networks, related to discussions about the tragedy in Talgar. Fakes about rallies in Almaty and other cities have appeared, edited from old videos of January events[51].

December 15, Akmola region, Shortandy village, A. Dzhakhin, 12 days of arrest under Article 488, Part 11 of the Code of Administrative Offences of the RK for violating of the law on the rules of holding a rally. This refers to the rally announced the day before on December 16 [52].

December 16, Almaty, Kazakhstan celebrated its Independence Day. The day before, the police went into high gear. A number of politically active citizens were detained in several regions of the country. They were sentenced to administrative detention for five to 20 days on various charges. At the same time, Internet users in Kazakhstan complained about a decrease in the speed of Internet connections[53].

December 18, Astana, inter-district court on civil cases, dismissed the suit of a lawyer Serikzhan Akhmetzhanov, a resident of East Kazakhstan region, against the government of Kazakhstan with a demand to cancel the decree on the time change[57].

December 18, Aktau city, there was information about the death of a man who committed a sapper burn near the building of the regional Akimat. During the day, journalists of lada.kz tried to contact the press service of the regional health department, and representatives of the regional hospital. But there was no response to phone calls and text messages[58].

December 18, Satpayev, Ulytau region, a strike began at Kazakhmys. More than 250 workers of the No. 65 mine of the Yuzhno-Kazakhstansky mine went down into the mine but refused to start work, demanding an increase in wages[59].

December 19, Almaty, “Aidar Mubarakov’s hunger strike in Almaty’s isolation ward has lasted for 20 days. His state of health is almost tragic. The situation is aggravated by the fact that the hunger striker does not have 60% of his stomach. Close relatives are not allowed to visit him, because the investigator of the DP Almaty Userov R., in violation of the norms of the CPC, unreasonably does not want to recognize them as public defenders. All petitions are ignored”, said lawyer E. Kakharov[62].

December 19, Semey, a woman R. for reporting a rally in a WhatsApp group was sentenced to a large fine. The court decided to impose an administrative fine under Article 434, Part 1 and Article 488, Part 7 of the Code of Administrative Offences of the RK in the amount of 73840 tenge and 184600 tenge respectively[65].

December 19, Almaty, at a press conference in Almaty, human rights defenders said that the human rights situation in Kazakhstan is deteriorating and that the conditions of detention of political prisoners in prisons and detention centers are tantamount to torture. The prisoners include M. Zhylanbaev, D. Muhammedkarim and A. Mubarakov[66].

December 19, Taldykorgan, D. Muhammedkarim, Articles 258, 405 of the Criminal Code of the RK, 7 years of imprisonment, was transferred from Taldykorgan to Kyzylorda. The lawyer G. Nurpeisov informs that the convicted person should serve his sentence in the colony where his relatives live, the right of D. Muhammedkarim is violated[67].

December 20, Zhezkazgan, striking miners of Kazakhmys Corporation appealed to President Tokayev K. with a statement that law enforcers were putting pressure on them[68].

December 20, Almaty, at night unidentified hackers broke into the server of the site Respublika.kz.media. The hackers made an attempt to completely destroy the database of the resource. On December 20, 2024 readers were unable to access the media portal[69].

December 20, Astana, the Prosecutor General’s Office reported the detention of administrators of the anonymous Telegram channel “QirSabyn” on suspicion of extortion. The detainees are suspected of extorting money “under the threat of publishing inaccurate information of a compromising nature”[70].

December 20, Karaganda, about 40 employees of the night shift of shop No. 9 of “ASIA FERROALLOYS” LLP appealed to the management of the enterprise with a demand to increase wages. When they refused, 20 workers stopped work[75].

At the beginning of the year, the Public Development Department ordered an information space monitoring service through public procurement: Akimat was interested in how media and bloggers evaluate the work of the authorities and E. The lawyer said that he had checked Kopeyev’s pages in social networks, but they contain only information on historical issues and no call to overthrow the government[90].

December 25, Aktobe, the Administrative Court held a hearing on the claim of human rights activist M. Dauylov on the recognition of illegal actions in the form of resolutions No. 2 of the Akim’s Office dated September 30, 2024 and March 29, 2024, which violate and restrict the right to assembly, freedoms and legitimate interests. The court decided to dismiss the lawsuit[91].

December 25, Aktau, A.Sarsenbayev was detained for 10 days for violating public order. He launched a drone at the site of the crash of the Azerbaijan Airlines plane, obstructing the work of rescue services and investigators, as well as failing to comply with the lawful demands of police officers[92].

December 25, Almaty, court hearing on the fact of death of E. Zhagiparov and A. Kapsalanov. Brother Nurlan Zhagiparov petitioned to change the preventive measure of the defendant A.Aubakirov to detention in custody. The judge of the military court of the Almaty garrison A.Sekenov refused to satisfy the petition [93].

December 25-26, Almaty, a regular court session was held on the case of the death of E. Zhagiparov and A. Kapsalanov during the January events. The witness is Bakytzhan Medetbekov. December 26, Astana, Director of the Legal Media Center D. Okremova answers the question “Is it possible to film a plane crash site?” And stresses that disasters are one of the most sensitive topics for journalists in terms of ethics[96].

December 26, Kazakh journalists regularly face violations of their rights. A report by Reporters Without Borders highlights this fact. According to the report, Kazakhstan ranks 142 out of 180 in the Press Freedom Index for 2024. The analysis indicates that in recent years there have been attempts by the state to tighten control over the work of the media. Journalists are not protected from violations of their rights and their activities are restricted[97].

December 27, Ust-Kamenogorsk city, public activist Leonid Kartashyov today sued the Ust-Kamenogorsk city Akimat for numerous refusals to hold rallies against the time shift and actually accused officials of lying to him[98].
