MONITORING OF POLITICAL PERSECUTION IN THE REPUBLIC OF KAZAKHSTAN FROM APRIL 1 TO APRIL 30, 2021

On April 1, political prisoner Muratbay Baimagambetov (Kyzylorda), who was in pre-trial detention, was hospitalized with a self-inflicted knife wound to his abdomen due to his disagreement with the politically motivated investigation and the unfair court proceedings. No investigative measures were taken during four out of the seven months when Baimagambetov, accused under Article 405, part 2 of the Criminal Code of the Republic of Kazakhstan, was kept in the pretrial detention facility[1].

On April 1, the court held that in respect of Fariza Bespaeva (Nur-Sultan city) the police department’s resolution on an administrative offense under Article 489, part 10 of the Administrative Offences Code of the Republic of Kazakhstan dated January 27, 2021, prepared by Lieutenant Colonel of the Baikonur police department, should be repealed[2].

On April 1, the Atyrau City Court returned to the civic activists Max Bokayev and Talgat Ayan their lawsuit seeking to cancel the amendments to the electoral legislation made in 2018. They named the President of Kazakhstan and the Speakers of the two Houses of Parliament as defendants[3].

On April 2, the deputy prosecutor of Nur-Sultan city signed the indictment on the newly initiated case under Article 405 Parts 1 and 2 of the Criminal Code of the Republic of Kazakhstan (“organization and participation in the activities of an extremist organization”) of the activist Zhahin Serik (Nur-Sultan city), who had previously been convicted in 2019 under Article 405 of the Criminal Code of the Republic of Kazakhstan[4].

On April 4, a rally was held in Altyntobe village (near Shymkent city) against the arrest of Zhasulan Mamatullaev, the director of the goldsmith shop that was detained by the police. The enterprise, which employed most of the villagers, was shut down. The authorities sent riot squads to the village “for maintaining public order,” which applied kettling[5]. On April 5, the Shymkent police drew up a report on 31 residents of the village for violating quarantine measures[6].

On April 5, the court allowed the KIBHR (Kazakhstan International Bureau for Human Rights and Rule of Law) appeal against the ruling of the Auezov District Branch of the Almaty City State Revenue Department on finding the NGO guilty of committing a violation under Article 460-1 of the Administrative Offences Code of the Republic of Kazakhstan, due to serious violations in drawing up a protocol without the participation of its representatives[7].

On April 5, the human rights organization CJF reported in its statement[8] that on March 16, the district court refused to clarify to activist Alnur Ilyashev (Almaty city) the “vague conditions” of his sentence, which also banned him from public and political activity for five years[9].

On April 5, the International Foundation for the Protection of Freedom of Speech “Adil Soz” filed a report about attacks on journalists by police officers, which go unpunished. Bek Abiyev was not given the chance to film the April 3 rally, Bakhrom Abdullayev was threatened with death while filming, and Bakhrambek Talibzhanov had been beaten up a month earlier[10].

On April 5, the court held to satisfy the complaint of the Public Association ECHO in full against the officials of the State Revenue Branch of the Almalinsk district, Almaty city, in connection with serious violations of the provisions of paragraph 1 of Part 1 of Article 741 of the Administrative Offences Code of the Republic of Kazakhstan and due to a lack of evidence[11].

On April 5, Medeu District Court No. 2 granted the motion of Asiya Tulesova (Almaty city) for grant of parole[12]. Tulesova was sentenced on August 12, 2020 under Article 378 and Article 380 of the Criminal Code of the Republic of Kazakhstan (“insulting and using violence against a representative of authority”) to 1 year and 6 months of restriction of liberty because she knocked the cap off a police officer’s head[13].

On the 5th of April G.S. Kazhibaev, the senior investigator of the Criminal Investigation Division of the Almaty Police Department classified the acts of the suspects under the Article 405 of the Criminal Code of the Republic of Kazakhstan (“participation and organization of an extremist activity”) Aspandiyarova Dametkan[14], Askhat Zheksebaev[15],  Abai Begimbetov[16], Kairat Klyshev[17], Dzhumaniyazova Ninagul[18], Gulzipa Dzhaukerova[19].

On April 5, Zhenis Zarkan, an ethnic Kazakh from China, appealed to the Ministry of Foreign Affairs of the Republic of Kazakhstan and also submitted an application to the Nur Otan party office in the capital, seeking assistance with family reunification. The Kazakhstani authorities have not taken any action for years[20].

On April 6 the acts of Diana Baimagambetova, a suspect under Article 182, Part 2 (“creating an extremist group”) and Article 405, Part 2 (“participation in an extremist organization”) of the Criminal Code of the Republic of Kazakhstan, were classified[21].

On April 6 the Almaty Specialized Administrative Court satisfied the complaint of the International Legal Initiative Founation, which requested to cancel the resolution of the Nauryzbai District State Revenue Branch dated February 4, 2021 in terms of finding the NGO guilty of committing a violation of Article 460-1 of the Administrative Offences Code of the Republic of Kazakhstan[22].

On April 6, the Police Department of Nur-Sultan, in response to a complaint filed by the Public Foundation Ar.Rukh.Hak regarding the violation of the rights of activist Musaeva Roza[23], submitted a response that no violations of rights have been found[24].

On April 7, political prisoner Aset Abishev, charged with participating in the activities of the DCK under Article 405, Part 2 of the Criminal Code of the Republic of Kazakhstan and Article 266, Part 1 of the Criminal Code of the Republic of Kazakhstan, slashed his wrists in protest against the alleged illegal search. On April 8, an investigation was initiated under the control of the prosecutor’s office. The forensic medical examination showed that Abishev had suffered light bodily injury. Abishev was depressed and required psychological counseling[25].

On April 7, Yerkin Sabanshiev (Talgar city), charged with “participation” in the activities of a banned organization under Article 405, Part 1 of the Criminal Code of the Republic of Kazakhstan, was sentenced to 1 year of restriction of liberty, a ban on using social networks for 3 years, he was placed under probation supervision, sentenced to 100 hours of forced labor, and also he was ordered to pay the court costs in the amount of 840 tenge ($2) and pay the amount of 27,780 tenge ($65) to the to the Victims Compensation Fund[26].

On April 7, the Court of Appeal reviewed the appeal against the decision in the criminal case under Article 405, Parts 1 and 2 of the Criminal Code of the Republic of Kazakhstan; Article 296 of the Criminal Code of the Republic of Kazakhstan against Baktybaev Bagdat (Shu city). The court commuted his sentence from 2 years to 1 year of restriction of liberty, and for the rest, it upheld the first instance judgment[27].

On April 7, there was an online presentation of the annual report “Human Rights in the Modern World” of the international human rights organization Amnesty International, which made an analysis of the human rights situation in Kazakhstan[28].

On April 7, Kusainov U.G., Head of the AK-159\25 facility, filed a civil suit against Elena Semenova for business reputation damage[29].

On April 8, the Criminal Investigation Division of the Department of the Anti-Corruption Agency of the Republic of Kazakhstan in the Aktobe region initiated a pre-trial investigation against the police officers under Article 146, Part 1 of the Criminal Code of the Republic of Kazakhstan (“torture”) for the severe beating of activist Reichert Roman (Martyuk village)[30].

On April 8, the Court of Appeal dismissed the complaint of the Public Foundation “Erkindik Kanaty” and refused to recognize the actions of the specialist of the Yesil District Branch of the Nur-Sultan city State Revenue Department as illegal[31].

On April 8, the Public Foundation “Legal Media Center” won the case against Kazakhstan in the UN Committee on Human Rights. The UN Committee urged Kazakhstan to provide adequate compensation to the author, Rozlana Taukina. The State party is also obliged to take all appropriate measures to prevent such violations[32].

On April 8, the Almaty City Police Department responded to a complaint filed by the Public Foundation “Ar.Rukh.Hak” regarding the violation of activist Bibigul Zholamanova’s[33] rights not to be subjected to police brutality by responding that the above arguments were not confirmed[34].

On April 8, the Turkestan Oblast Police Department responded to a complaint filed by the Public Foundation “Ar.Rukh.Hak” on the violation of the rights of activist Dzholdasova  Aizhan[35], by responding that an internal investigation was initiated against police officers[36].

On April 9, the Almaty City Police Department responded to a complaint filed by the Public Foundation “Ar.Rukh.Hak” with regard to Shokanova  Kamilla [37], about kidnapping by responding that it was not possible to establish the identity of the kidnappers[38].

On April 9 the Police Department of the East Kazakhstan Region responded to a complaint filed by the Public Foundation “Ar.Rukh.Hak” about the violation of the rights of activist Zhubanov Tlegen[39], claiming that there had been no violation by the police officers[40].

On April 9 the Iliysk district court found Dzhakupov Kanat (Almaty region) guilty under Article 405, Part 2 of the Criminal Code of the Republic of Kazakhstan (“participation in an extremist activity”) and sentenced him to 1 year of restriction of liberty; he was also prohibited to engage in public, social and political activities and use social networks for 2 years; he was sentenced to pay 27,780 tenge ($65) to the Victims Compensation Fund[41].

On April 9, there was a briefing on the work of the state commission for the rehabilitation of the victims of repression, at which Deputy Prime Minister Eraly Tugzhanov said that there was no political repression in the country[42].

On April 9, Farida Kabylbek, an ethnic Kazakh woman from Xinjiang who had been protesting outside the Chinese consulate for about two months, met her husband, Rakhyzhan Zeinolla, at the Almaty airport. The flight arrived from the Chinese city of Chengdu[43].

On April 12 the trial against Aliya Zhakupova, who was brought before the court as a suspect under Article 405 of the Criminal Code of Kazakhstan, started in the Saryarka district court of Nur-Sultan city[44].

On 12 April Dzhanzakova Sholpan and Turdieva Ulbolsyn (Aktau city) were fined 145850 tenge each ( a fine of $335 per person) for allegedly “violating the law on peaceful assemblies” under Article 488 of the Administrative Offences Code  of the Republic of Kazakhstan for a peaceful picket outside the Akimat building on March 20, 2021 demanding freedom for political prisoners[45].

On April 12, the Court of Appeal dismissed the complaint of Nurmaganov Askar (Karaganda city)[46].

On April 12, OSCE Chairperson-in-Office Ann Linde, during her visit to Nur-Sultan city, discussed human rights issues, such as media freedom and equality with civil society actors[47].

On April 13 the online trial of Kayyrbek Askar, accused under article 405, Parts 1 and 2 of the Criminal Code of the Republic of Kazakhstan (“creating and participating in an extremist organization”) began in the Saryarka district court of Nur-Sultan city[48] [49].

On April 14 in Petropavlovsk, a Khabar TV crew came to one of the city’s outpatient clinics to look into the situation regarding the payment of so-called “covid” bonuses, causing the acting chief physician to file a police report against the correspondent Natalia Volkova[50].

On April 15, the court session of Yeskhozhin Erbol (Nur-Sultan city) began. In December, the charges were reclassified from part 2 of Article 405 of the Criminal Code of the Republic of Kazakhstan to Part 1, charging him with “organizing the activities of the organization Koshe Partiyasy, which is banned by the court”. During the session, the lawyer reported that “psychological pressure” was exerted on Yeskhozhin in the pre-trial detention facility.[51].

On April 15, political prisoner Kenzhebek Abishev, convicted under Article 256 of the Criminal Code of the Republic of Kazakhstan, was taken from the penal colony (Facility LA-155/14 in the village of Zarechnyi, Almaty region) to the Kapshagai city hospital with “renal colic”, because on April 11 Abishev went on hunger strike (after 7 days voluntarily ended) in protest against the court decision to keep him in prison. Doctors at the Kapshagay hospital diagnosed coronary heart disease[52].

On April 15, the court changed the preventive measure for two activists from Aktau to a pledge not to leave the place for the period of the investigation under Article 405, Part 2 of the Criminal Code of the Republic of Kazakhstan: for Abzal Kanaliev — detention in a pre-trial detention facility, for Ismakova Aizhan — house arrest[53].

On 16 April it was reported that political prisoner Syzdykov Aidar (Nur-Sultan city), accused under Article 405, Part 1 of the Criminal Code of the Republic of Kazakhstan, is subjected to pressure by staff of the pre-trial detention facility: Every day, the officers conduct recorded searches in Syzdykov’s cell, do not give him food and cigarettes on time, take away books and newspapers, improperly accuse him of violating the regime, and threaten him with cellular confinement. The officers also set fellow inmates against Syzdykov[54].

On April 16, an indictment was drawn up in the criminal case against Sabitov Aibek (Nur-Sultan city) under Article 405, Part 2 (“participation in an extremist organization”) of the Criminal Code of the Republic of Kazakhstan[55].

On April 19, the Kyzylorda City Court acquitted Zibash Abdieva, a journalist for the HALYQLINE.KZ website, who had been accused of insulting by the head of Infrakos institution, K. Iryukov[56].

On April 19, 95 Fircroft employees[57] and 50 MADIBA employees[58] in Zhanaozen city went on strike for more pay. On April 29, company executives disbanded the strikers, having promised a wage increase[59].

On April 20, the court found guilty and sentenced Muratbai Baimagambetov (Kyzylorda city), charged with supporting the “Koshe Partiyasy” movement, to 2 years of restriction of liberty with probation for the entire term. The court also sentenced Baimagambetov to 100 hours of social work and ordered him to pay 27,780 tenge ($65) to the Victims Compensation Fund and 840 tenge ($2) as court costs[60]. On April 14, his qualification in the criminal case was changed from Part 1 of Article 405 of the Criminal Code to Part 2 of Article 405, having qualified him as a participant rather than an organizer[61].

On April 20, the Mangistau Oblast Police Department responded to a complaint filed by the Public Foundation “Ar.Rukh.Hak” concerning Turdieva Ulbolsyn[62], about violations of the rights of the activist with the reply that a pre-trial investigation on abuse of office by police officers had been initiated[63].

On April 21 Kulyshev Nurbek (Uralsk city) was sentenced to 15 days of arrest under Article 488, Part 6 of the Administrative Offences Code of the Republic of Kazakhstan for his participation in the memorable event at the Dulat Agadil mosque on February 28, 2021[64].

On April 21, Bekbolat Mukanaliuly (Atyrau region) was sentenced to 15 days of arrest under Article 488, Part 7 of the Administrative Offences Code of the Republic of Kazakhstan for having called a peaceful rally against the sale of land[65].

On April 21 there was a court hearing on the submission from the probation service on substitution of restriction of liberty for imprisonment against Roman Reychert (Martyuk village) who was convicted under Article 405, Part 2 of the Criminal Code of the Republic of Kazakhstan by the court decision of June 26, 2020. The court decided to reject the submission of the probation service[66].

On April 22, the Pavlodar court admitted the claims filed by prisoner Veronika Savelyeva “For the protection of honor, dignity and compensation for moral harm” against Elena Semenova, but reduced the amount of compensation for harm to 100 thousand tenge (235$)[67].

On 22 April Dauren Sultangali (Kostanai city) was sentenced to 5 days in detention under Article 488, Part 7 of the Administrative Offences Code of the Republic of Kazakhstan for having called a rally on 24 April 2021[68].

On 23 April Bekbulat Utebayev (Uralsk city) was arrested for 10 days under Article 488, Part 6 of the Administrative Offences Code of the Republic of Kazakhstan for participation in the rally on 28 February in Uralsk[69].

On April 23, human rights activist Vadim Kuramshin (Nur-Sultan city) was arrested on a charge of organizing a rally of Komsomolsky housing complex shareholders; he was sentenced to 10 days of arrest for “organizing an illegal meeting” under Article 488, Part 7 of the Administrative Offences Code of the Republic of Kazakhstan, despite the fact that he had submitted a notification to the akimat. Kuramshin suspected he had a coronavirus, but no ambulance was called[70].

On April 24, rallies were planned in several cities with the demand “Zher Satylmasyn” (“No to the sale of land”). 17 preventive political persecution in 9 cities and localities and 13 other forms of preventive political persecution, including detentions, threats of administrative and criminal prosecution, «preventive conversations,» etc., were identified[71], as well as 9 politically motivated refusals to hold peaceful assemblies on May 1, 2021 in six cities[72].

Almaty. About 200 people gathered for a rally against the draft law on land currently before parliament. They came to the square in front of the Academy of Sciences building to demand to stop consideration of the amendments to the legislation. The rally was not agreed upon by the local authorities. The akimat refused to approve the request to hold the rally, which was submitted by the activist Zhanbolat Mamay, referring to the worsening epidemiological situation and rising coronavirus rates. Mobile Internet in the square and adjacent neighborhoods was not available. Central Park was closed for “disinfection”[73].

Nur-Sultan. There was a large concentration of police near the building of the Tennis Federation, car traffic was blocked.

Shymkent.  The police cordoned off the Kiyal Alemi Park. This place was pointed as a rally point for holding a rally.

Semei. The rally did not take place. 13 activists gathered in the square named after Auezov, but it was decided not to hold the rally due to the absence of the organizer Daulet Mukazhanov, who had submitted a notice of peaceful assembly to the akimat[74].

Uralsk. There were less than two dozen people in Manshuk Mametova square for the action, which was not agreed upon with the akimat. The organizers and participants of the action could not get into the square.From the early morning police officers were strenuously patrolling the area around the square: police cars and uniformed officers were stationed in nearby courtyards and at the closest intersections[75].

On April 26, Bauyrzhan Alipkaliev (Uralsk city), one of the three organizers of the February 28 agreed rally in Uralsk city, was arrested for 10 days under Article 488 part 3 of the Administrative Offences Code of the Republic of Kazakhstan for “violation by the organizer of an agreed peaceful assembly”. This was caused by statements made during the rally, which was held on February 28, 2021[76].

On April 26, the PF “Ar-Bedel” filed a suit against Dzhakhin Amangeldy (Akmola region) for a repost he made on October 15, 2020, with “deliberately false information that offended the honor and dignity of the first President — Yelbasy”[77].

On April 26, Daniyar Baitileu (Shymkent city) was sentenced to 15 days in jail under Article 488 Part 11 of the Administrative Offences Code of the Republic of Kazakhstan for having called for an unauthorized action[78].

On April 27, political prisoner Almat Zhumagulov was beaten in penal colony (Facility LA-155/14 in the village of Zarechnyi, Almaty region), where he is serving a term of imprisonment under Article 256 of the Criminal Code of the Republic of Kazakhstan[79].

On April 27, Nurbol Onerkhan (Birlik village, SKR) received a summons to appear in court regarding the replacement of restriction of liberty with deprivation of liberty. Onerkhan reported that he had not violated the conditions of probation[80]. Later, on May 4, his restriction of liberty was changed to deprivation of liberty by the court order and he was taken into custody in the courtroom.

On April 27, Nurzhan Mukhammedov (Shymkent city), who has been kept in the pretrial detention facility for 4 months on suspicion under Article 405, Part 1 of the Criminal Code of the Republic of Kazakhstan, went on hunger strike demanding to drop the criminal case[81].

On April 27, three ethnic Kazakhs, Kaisha Akan, Murager Alimuly, and Kaster Musakhanuly, who fled Xinjiang for Kazakhstan, requested that authorities grant them citizenship or a certificate allowing them to leave for a third country. A representative of the Migration Police stated that “those who cross the border illegally are not allowed by law to obtain Kazakh citizenship”[82].

On April 27, more than a dozen mothers from Kyzylorda arrived in Nur-Sultan to address housing, childcare and health issues and headed for the administration building of the President of Kazakhstan. But the security officers blocked their way to Akorda. The women made their way to the Ministry of Labor and Social Protection, where they tried to book an appointment[83].

On April 27, Gulmira Akhmanova (Almaty city) was arrested for 12 days under Article 488 Part 6 of the Administrative Offences Code of the Republic of Kazakhstan for “violation of the procedure for organizing and holding peaceful assemblies”. She participated in the action on 2.04.2021, demanding the release of Baimagambetov Muratbay[84].

On April 28, Rakilya Beknazarova (Almaty city) was arrested for 15 days under Article 488 Part 11 of the Administrative Offences Code of the Republic of Kazakhstan for “violation of the law on peaceful assemblies”. She participated in the action on 2.04.2021, demanding the release of Baimagambetov Muratbay[85].

On April 28, Aimukhametova Saule (Almaty city) was arrested for 15 days under Article 488, Part 11 of the Administrative Offences Code of the Republic of Kazakhstan for participating in an unauthorized public action, committed repeatedly within a year after the imposition of an administrative penalty[86].

On April 28, the court ruled on the complaint of the MediaNet International Center for Journalism against the ruling of the Bostandyk District State Revenue Branch of Almaty city to reverse the resolutions of the Bostandyk District State Revenue Branch, to stop proceedings for a lack of evidence, and to make special rulings to the Bostandyk District State Revenue Branch of Almaty city and the Almaty City State Revenue Department[87].

On April 29, Yergali Kulbayev (Shymkent city) was arrested for 10 days under Article 488 Part 11 of the Administrative Offences Code of the Republic of Kazakhstan for participating in an unauthorized public action, committed repeatedly within a year after the imposition of an administrative penalty[88].

On April 29 the court found the journalist and blogger Aigul Utepova (Nur-Sultan city) guilty under Article 405, Part 2 of the Criminal Code of the Republic of Kazakhstan (participation in an extremist organization) and sentenced her to 1 year of restriction of liberty, also prohibiting her from public and political activities, including working in the media and telecommunications for 3 years, and sentenced her to 100 hours of forced labor. The court also charged Utepova with court costs in the amount of 8,668 tg ($20) and an involuntary payment of 27,780 tenge ($65) to the Victims Compensation Fund[89].

On April 29 Toleubekov Birzhan (Almaty city) was sentenced to 15 days of arrest under Article 488, Part 6 for a one-man picket with a poster “Nur-Otan tal merken kutty bolsyn 30 zhyl” (Congratulations to Nur-Otan on its 30th anniversary) near the building of the city branch of the Nur-Otan party on April 1, 2021[90].

On April 30, the appellate panel of the West Kazakhstan regional court dismissed the complaint of Baurzhan Alipkaliev, who tried to appeal his arrest for 10 days imposed on him as the organizer of a peaceful and agreed rally for words from another organizer’s speech[91].

On April 30, the court issued a warning to Marua Yeskendirova (Uralsk city) under Article 488 Part 6 (“Violation of the Procedure for Organizing and Holding a Peaceful Assembly”) for her participation in the peaceful action in Uralsk on April 24[92].

On April 30, Almaty akimat distributed a message about the changes in the work of public transport on May 1 and 2 in the area of the Central Park, which the city authorities planned to close on the weekend “for disinfection”. Mukhtar Ablyazov, the leader of the outlawed Democratic Choice of Kazakhstan movement, indicated this park as the place of Saturday’s protest rally. (The DCK movement, defined as an “extremist organization” by the capital city’ court, is considered by the European Parliament resolution as a peaceful opposition group). There were no buses to the Central Park[93].

Administrative arrests on April 30: Kemelbaev Nuruslan (Almaty city) under Article 488, Part 7 — 14 days for calling for a rally on May 1 in the Facebook social network; Kaziev Yerkin (Kaskelen city, Almaty region) under Article 667, Part 1 — 2 days; Yntymakova Zhanna (Almaty city) under Article 488, Part 6 — 13 days, Imangaliyeva Bibigul (Almaty city), Article 488, Part 6 — 15 days; Yerezhepova Kulbarshyn (Almaty city), Article 488, Part 6 — 11 days; Yusupov Niyazbek (Almaty city), Article 488, Part 6 — for participating in the public event of 02.04.2021 near the Almaty Police Department in support of Baimagambetov M, Nurgazin Bolat (Aktau city) under Article 488 Part 12 — 5 days for calling a rally in the Facebook social network on May 1 against price hikes, Turdieva Ulbolsyn (Aktau city) under Article 488 Part 2 — 15 days for participating in a picket on 11 and 20 April, Turdiyeva went on a dry hunger strike in protest[94].

Pickets at the Chinese consulate in Almaty have been going on for three months, the participants of which call for the release of their families staying in Xinjiang, condemning Beijing’s policy against Muslims in this region of north-western China. The police did not allow protesters to come to the gates of the consulate closer than a few tens of meters[96].
